Australia Rental Agreement
To get the best experience and satisfaction from your self drive
holiday, it is important to carefully read the terms and conditions that
will apply to any rental agreement.
RATES AND CONDITIONS

Rates and Conditions quoted in brochures and/or documentation are
subject to change without notice. Please note all prices quoted in this
document are in Australian dollars. The Customer will pay Britz any
government fees and duties etc, and any other fees or charges payable by
the Customer pursuant to this agreement. This includes any costs
incurred by Britz as a result of any breach by the Customer of the terms
of this agreement.
RENTAL DURATION

1) Campervans
When calculating the number of days the Vehicle is rented, the day of
pick-up is counted as day one of the rental, regardless of pick-up time.
The day of the Vehicle’s return is counted as the final day of the
rental. When a rental moves from one rate season into the next, the
calculation is based on both rates.
(a)
Rental days are calculated on a calendar basis. This means that the
Customer is charged for the whole day on which the Customer collects the
Vehicle regardless of the time at which he or she collects or returns
the Vehicle, which may be at any time within business hours.

(b) Minimum rental period is 5 days. Minimum
rental period is subject to change during peak periods.

(c) Minimum rental period for one-way rentals is 7 days, this
excludes multiple rentals, which are subject to a 5 day minimum rental
period. Shorter hires are available on application only.

(d) Late pick up or early return of the Vehicle does not
entitle the Customer to any refund of the unused portion of the rental.

Failure to obtain an authorisation for a rental extension will
result in a daily fee of AU$150 in addition to the daily rental rate.
Late returns will be charged on a per day basis e.g. if the vehicle is
returned 1 day late, a late return fee equivalent to one day’s rental
will be charged; if the vehicle is returned two days late, a fee
equivalent to two day’s rental will be charged and so on. The rate
charged will be based on Britz standard rental rates per vehicle for the
rental period.
2) Rental Cars
Rental days are calculated on a 24-hour basis. This means that on the
day of return, the Customer must return the Vehicle at or before the
time at which he or she collected the Vehicle on the day of pick-up, or
the Customer will be liable for return charges detailed below.
(a)
Minimum rental period is 1 day for 2WD cars and 3 days for 4WD cars.
Minimum rental period is subject to change during peak periods.

(b) Minimum rental periods apply to one-way rentals, set out
under the heading ‘One-way Rentals’ in this document.

(c) When a rental moves from one rate season into the
next, the calculation is based on both rates.

(d) Late pick up or early return of the Vehicle does not
entitle the Customer to any refund of the unused portion of the rental.

(e) Britz allow a grace period of 59 minutes before the
Customer is liable for late return charges.

- 1 hour late, one third of the daily rate will apply.
- 2 hours late, two thirds of the daily rate will apply.
- 3 hours late, one full day rate will apply.

Failure to obtain an authorisation for a rental extension will
result in a daily fee of AU$150 (4WD Rental Cars) in addition to the
daily rental rate. The rate charged will be based on Britz standard
rental rates per vehicle for the rental period.
DELIVERY AND RETURN OF THE VEHICLE

(a) The Customer acknowledges having received the Vehicle in a
clean condition and in sound working order, in accordance with the
Vehicle Condition Report, and with a full fuel tank and a full bottle of
gas (if applicable);

(b) The Customer will return the Vehicle in a clean condition
with a full fuel tank and a full bottle of gas (if applicable) (subject
to any pre-purchase fuel and/or pre-purchase gas option being taken), on
the return date, time and location set out under the heading ‘Travel
Dates’ in the Rental Agreement.

(c) The Customer acknowledges that Britz will not refund to the
Customer any monies, nor have any obligation to provide a replacement
Vehicle, if the Vehicle is returned or the Customer ceases to have the
use of the Vehicle prior to the return date for any reason.
CHANGE OF DROP-OFF DESTINATION

If the Customer wishes to change the drop-off destination after
the rental has commenced, they must first obtain authorisation from the
destination branch. Subject to the change being approved, an additional
charge of up to AU$700 will apply. If the Customer is required to change
the drop-off destination due to circumstances out of Britz’s control
(i.e. weather conditions), the fee will still apply.
LATE
DROP-OFFS

If the Customer wishes to drop-off the Vehicle after business hours,
they must first get approval from the destination branch. Subject to
approval, the Customer will be required to pay an extra day’s premium
(based on the Excess Reduction Option selected) as they will be held
responsible for the Vehicle up until the time that it is checked in by a
Britz staff member.
RENTAL EXTENSION

If the Customer wishes to extend the rental whilst on hire, they must
first obtain authorisation from the destination branch. This is subject
to availability. The extra cost of an extended rental must be paid by
credit card over the telephone on confirmation of the rental extension.
Failure to
obtain authorisation will result in a daily fee of AU$150 in addition to
the daily rate. The rate charged will be based on Britz standard rental
rates per vehicle for the rental period.
AMENDMENT FEE

Campervans Only
An amendment fee of AU$20 per amendment is charged when a change to an
existing booking is made. This applies but is not limited to changing
the Name, the vehicle type, reducing the number of rental days, changing
pick up dates or changing the pick up or drop-off location. Where the
number of rental days is being extended, the amendment fee will not
apply.
RENTALS IN BROOME

Campervans & 4WD Rental Cars Only
An additional remote location fee of AU$400 applies to all rentals
picking up or dropping off (or both) in Broome. Only one remote location
fee is charged per vehicle. This is in addition to One-Way fee if
applicable.
TRANSFERS

Britz clients will need to make their own way from the airport to the
Britz branch, at their own cost. Note: Taxi fee reimbursement is
included in the Inclusive Campervan component.
AIRPORT CONCESSION FEE

Campervans
An airport concession fee may be charged for hires with pick-up or
drop-off from airport locations. An airport pick-up fee of AU$16.50 per
hire will apply for hires with pick-up at Hobart airport. This fee is
subject to change.

2WD Rental Cars
An airport concession fee will be charged for hires that pick-up from
airport locations. Vehicles picked up from non-airport locations can be
returned to airport locations and no fee will be payable. A complete
list of airport concession fees, referred to as Premium Location
Surcharge (PLS) can be obtained upon booking or by the Customer Service
Representative upon pick-up.

4WD Rental Cars
An airport concession fee may be charged for hires with pick-up or
drop-off from airport locations. An airport pick-up fee of 4% of the
total hire cost will apply for hires with pick-up at Hobart airport.
This fee is subject to change.
EXTRA DRIVER FEE

Campervans Only
An extra driver fee of AU$3 per day (maximum charge AU$150) applies per
additional driver. Note: Additional drivers fees are included in the
Inclusive component.
ONE-WAY RENTALS

Campervans
One-way rentals are available between all branch locations. One-way
rentals between Tasmania and the mainland are available on request. A
One-way rental fee of AU$220 is charged, this is in addition to the
Broome surcharge fee if applicable.
2WD
Rental Cars
One-way rentals are available between all branch locations, excluding
Tasmania and the mainland. Pick up or drop off into or out of the NT
(Alice Springs, Ayers Rock Airport, Darwin) and into, out of or between
WA locations (Perth, Broome) incur a 10 day minimum rental period and a
one-way fee of $500, payable at time of pick up.
A
locations matrix showing all locations and the relevant minimum days can
be obtained upon booking or by the Customer Service Representative upon
pick-up. Please note that listed cities includes both Airport and
non-airport locations. Rentals between the city and airport locations in
the same city do not attract one way rental fees or minimum day
requirements.
4WD Rental Cars
One-way rentals are available between all branch locations (excluding
to/from Tasmania and the mainland). One-way rental fees and minimum
rental periods will apply:

Pick-up and drop-off in Adelaide, Brisbane, Cairns, Melbourne, Sydney.
No one-way fee/7 day minimum rental period

Pick-up or drop-off in NT (Alice Springs, Darwin) and WA (Perth,
Broome). One-way fee AU$500/10 day minimum rental period
The one-way fee is in addition to the Broome surcharge fee if
applicable.
MULTIPLE RENTALS

Should a hirer have more than one rental (multiple rentals) then these
rentals can be combined to qualify the hirer for our long term rate.
Campervan and car rentals in Australia, New Zealand and Southern Africa,
for both Britz and Maui, can be combined to qualify if travel is within
a 3 month period.

e.g. One 14 day rental plus one 7 day rental qualifies for the 21 day
rate.

The One-way Fee (if applicable) and charges for additional hire
equipment and additional extras will be charged per vehicle rented.
CAMPERVANS

For Pick-ups and Drop-offs on the same day, the daily rental
charge for the last day of the 1st rental will be charged, and the daily
charge for first day of the subsequent rental will not be charged. This
will also apply to the Excess Reduction charge.
ON-ROAD ASSISTANCE

Any problems associated with the Vehicle, including equipment
failure, must be reported to Britz as soon as possible, and within 24
hours in order to give Britz the opportunity to rectify the problem
during the rental. Failure to do so will compromise any claims for
compensation. Britz do not accept liability for any claims submitted
after this period. Please contact Britz on:

ROAD RESTRICTIONS
2 Wheel Drive vehicles must not be used by the Customer or any
authorised driver (unless authorised by us in writing) on any unsealed
road (being a road not sealed with a hard material such as tar, bitumen
or concrete). No vehicle may be used in off-road conditions. Off road
conditions include, but are not limited to: fire trails, beaches, sand,
tracks, fields or paddocks. The only exception to this is reasonable use
of access roads to recognised commercial campgrounds.

4 Wheel Drive vehicles can be driven on recognised
unsealed tracks. 4 Wheel Drive vehicles may only travel to the following
areas with the written permission of Britz: Simpson Desert, Strzelecki
Track, Gunbarrel Highway, Cape York, the Bungle Bungles, Oodnadatta
Track, Birdsville Track, Tanami Track and Gibb River Road. Permission
being granted is subject to weather and road conditions.
Vehicles
are not permitted on the Canning Stock Route, the Lost City in
Litchfield Park and the Telegraph Road section of the road to Cape York.
The Customer is responsible for damage if travelling on these roads as
there is no Excess Reduction cover.
Britz
reserve the right at its sole discretion to restrict vehicle movements
in certain areas due to adverse road or weather conditions, and the
distance to nominated destinations in relation to the length of the hire
period.
LICENCE

A full resident country driver’s licence, held for a least one
year, is to be presented at the time of rental. If the licence is not in
English format, an international driver’s licence is also required.
AGE
RESTRICTIONS

Drivers must be 21 years of age or over. A medical certificate
stating that the customer is fit to drive the vehicle they have booked
for the duration of the hire is required for drivers over the age of 75.
CANCELLATION FEE

Campervans
The cancellation fees are:

cancelled up to 60 days prior to pick-up: No Fee

cancelled from 60 to 30 days prior to pick-up: 20% of Gross Rental

cancelled from 60 to 30 days prior to pick-up: 50% of Gross Rental

If
cancelled 29 to 7 days prior to pick-up: 100% of Gross Rental

vehicle is returned early for any reason whatsoever: No refund
available
4WD
Rental Cars
The cancellation fees are:

cancelled up to 21 days prior to pick-up: No Fee

cancelled from 21 to 7 days prior to pick-up: 20% of Gross Rental

cancelled from 6 to 1 days prior to pick-up: 50% of Gross Rental

If
cancelled on day of pick-up or No-Show: 100% of Gross Rental

vehicle is returned early for any reason whatsoever: No refund
available
USE
OF THE VEHICLE

The Customer agrees that, during the Rental Period, the Customer will
not allow the Vehicle to be:
(a) driven otherwise than in a cautious, prudent and normal
manner;
(b) used in a manner which could cause damage;
(c) driven in a prohibited area or in an area other than the
areas (if any) indicated to the Customer by Britz;
(d) driven by a person under the influence of alcohol or drugs or
with a blood alcohol level in excess of that permitted by law;
(e) left with the ignition key in the Vehicle while it is
unoccupied;
(f) driven by a person:
(i) under the age of 21 years; or
(ii) who is not authorised by law to drive the Vehicle. Particulars of a
proposed licensed driver of the Vehicle are set out under the headings
‘Licence’ and ‘Age Restriction’ in the Rental Agreement.
(g) damaged by:
(i) submersion in water
(ii) contact with salt water
(iii) creek or river crossing
(iv) driving through low plain flooded areas
(v) beach driving
(h) used for any illegal purpose or in any race, rally or
contest;
(i) used to tow any vehicle or trailer ;
(j) used to carry passengers or property for hire or reward;
(k) used to carry more persons than is permitted by any relevant
authority or detailed in the Vehicle manual or on the Vehicle or
specified in this Agreement;
(l) used to carry volatile liquids, gases, explosives or other
corrosive or inflammable material;
(m) otherwise used in breach of the Customer’s obligations under
this Agreement.
ALTERATIONS TO VEHICLE

The Customer shall not make any alterations or additions to the Vehicle
without the prior written consent of Britz.
ANIMALS

The Customer will not allow any animals to be carried in the
Vehicle, excluding guide dogs.
MAINTENANCE AND REPAIRS

(a) The Customer shall take all reasonable steps to properly
maintain the Vehicle, including daily checks of the oil, water and
batteries;
(b) The Customer acknowledges that Britz will reimburse for
expenditure up to AU$100 (campervan rentals) reasonably incurred in
rectifying any mechanical failure to the drive train and engine of the
Vehicle (not including the water system, refrigerator, heating and
air-conditioning unit and audio equipment)

PROVIDED THAT:
(i) the Customer produce relevant receipts;
(ii) the Customer has received the prior consent of Britz;
(iii) the damage is not due to the Customer’s fault or their breach of
this Agreement.

(c) Subject to the terms of the Excess Reduction, the Customer
will pay for the cost of repairing or replacing tyres damaged during the
Rental Period

PROVIDED THAT Britz will reimburse the Customer for expenditure
reasonably incurred if:
(i) the Customer produces relevant receipts; and
(ii) the tyre is defective and is returned by the Customer to Britz for
inspection; and
(iii) the manufacturer accepts liability under its warranty.

(d) The Customer will be liable for any cost associated with the
incorrect use of fuel (fuel being diesel or petrol).
(e) The Customer will pay Britz the daily rental rate for the
period the vehicle is off fleet for accident repairs (demurrage)

Campervans Only

For repairs costing over AU$100, Britz will need to be informed in
advance. Repairs will be approved provided the Customer was not directly
responsible for the damage. Receipts must be submitted for any repair or
the claim will not be paid.
VOLUNTARY DOWNGRADE

Should the Customer decide to take a lesser vehicle than booked
they will not be entitled to any refund.
VEHICLE CATEGORY

Vehicles cannot be requested by make or model, only by vehicle
category
CHANGE OF VEHICLE

Should the vehicle booked be unavailable through unforeseen
circumstances, Britz reserve the right to substitute an alternative
vehicle without prior notification and at no extra cost, save for any
additional running costs pertaining to the substitute vehicle. This
shall not constitute a breach of contract and does not entitle the
Customer to a refund.
TITLE TO VEHICLE

The Customer acknowledges that Britz retain title to the Vehicle and
that the Customer possesses the goods as a mere bailee only. The
Customer does not have any right to pledge Britz’s credit in connection
with the Vehicle and agrees not to do so. The Customer shall not agree,
attempt, offer or purport to sell, assign, sub-let, lend, pledge,
mortgage, let on hire or otherwise part with or attempt to part with the
personal possession of or otherwise deal with the Vehicle.
VEHICLE DAMAGE - EXCESS REDUCTION OPTIONS

The Customer understands that:
(a) the Vehicle is insured for damage to the Vehicle or the
property of a third party;
(b) the Customer will have to pay an excess in respect of any
damage;
(c) the excess may be reduced or removed, in most circumstances,
by taking out an Excess Reduction.
(d) the Customer will not have any Excess Reduction and will be
responsible for the total cost of any damage, if the Customer breaches
any of the terms of this Agreement.
FOR
YOUR PROTECTION

Personal Injury is covered in most cases through Registration
Third Party Insurance. We strongly recommend that all people travelling
in Australia take out Personal Travel Insurance.

All vehicles are insured for the damage to the vehicle or to the
property of a Third Party. The Customer is responsible for the first
AU$5,000 (“the excess”) for Campervans and the 4WD Rental Car and the
first AU$2,000 (“the excess”) for 2WD Rental Cars of the cost of damage
to Third Party property or to the rented vehicle, including single
vehicle accident, windscreen and tyre damage, overhead and underbody
damage, towing and recovery costs, theft, fire, break-in, vandalism.
This also includes the cost of the daily rental for the period the
vehicle is off fleet for accident repairs (demurrage).

The excess applies in respect of each claim, not rental.

The excess is applicable regardless of who is at fault and must be paid
at the time the accident report is completed, not at the completion of
the rental. The excess will be refunded if Britz are successful in
recovering the cost of the damages from the third party. Please note
that third party Claims can take months or even years to resolve.

This excess can be reduced, in most circumstances, by the purchase of
Excess Reduction Option 1 or Excess Reduction Option 2 for Campervans
and the 4WD Rental Car, or the Excess Reduction Option for 2WD Rental
Cars.

Please see the ‘Exclusions’ section below, whereby all Excess Reduction
and Premium cover will be made void.

period the vehicle is off fleet for accident repairs (demurrage)The
excess applies in respect of each claim, not rental. Please see the
‘Exclusions’ section below, whereby all Excess Reduction cover will be
made void.

Note: Excess Reduction Option 2 is included in the Inclusive
component.
CAMPERVANS & 4WD RENTAL CARS – PREMIUM COVER OPTION (PCO)
Where PCO is taken out at a flat rate of AU$40 per rental (2WD and 4WD)
in addition to Excess Reduction Option 2, the hirer will not have to pay
any excess at all for any damage to the vehicle or property of a third
party. Note: PCO is included in the Inclusive component.

BRITZ STRONGLY RECOMMEND THAT CUSTOMERS TAKE EXCESS REDUCTION OPTION 2
AND PREMIUM COVER OPTION FOR TRAVEL WITH COMPLETE PEACE OF MIND.
EXCLUSIONS

The Customer’s responsibility for the following damage costs is not
limited to the amount specified in the Standard Excess, the Excess
Reduction Options and PCO:
1. Any water related damage, which includes but is not limited
to:
a) any vehicle submersion
b) creek or river crossing
c) driving through low plain flooded areas
d) beach driving
2. Personal belongings: Britz recommend the Customer does not
leave valuables in the vehicle and that they take out personal
insurance.
3. All Excess Reduction is void if the terms of the Rental
Agreement are breached. The Customer will be responsible for the total
cost of any damage. This will also include any damage caused by willful
misconduct (e.g. sitting or standing on the bonnet or roof of the
Vehicle) and driving under the influence of alcohol or drugs and proven
negligence resulting in damage to the hired Vehicle or Third Party
vehicle/property.
4. All Excess Reduction is void if the Customer is proven to have
not abided by the current road rules, resulting in damage to the hired
Vehicle or Third Party vehicle/property. The Customer will be
responsible for the total cost of damage.
5. The incorrect use of fuel (fuel being diesel or petrol). The
Customer will be responsible for any associated cost.
6. The cost to retrieve or recover a vehicle which has become
bogged, regardless of the Excess Reduction Package taken.
7. The cost to replace keys which have become lost, stolen, or
retrieval of keys which have been locked in the Vehicle.
VEHICLE SECURITY DEPOSIT

On pick-up of the Vehicle, the Customer agrees to pay a Vehicle Security
Deposit. The Customer authorises Britz to deduct from the Security
Deposit any amounts due by them to Britz arising out of the agreement.
The Vehicle Security Deposit amount is determined by the Excess
Reduction Option selected:

Campervans & 4WD Rental Vehicles
If the Customer does not take Excess Reduction Option 1 or Excess
Reduction Option 2, the Security Deposit is AU$5,000 payable by cash,
Traveller’s Cheques, or credit card. Should the Deposit be paid by
credit card, the amount will be debited to the Customer’s account
immediately. Should the Deposit be paid by cash, a cash qualification
process will apply.

If Excess Reduction Option 1 has been taken the Security Deposit
is AU$2,500 payable by cash, Traveller’s Cheques or credit card. If paid
by credit card, authorisation will be gained for the Au$2,500 Security
Deposit. Should the Deposit be paid by cash, a cash qualification
process will apply.

If Excess Reduction Option 2 has been taken the Security Deposit
is AU$220 (2WD vehicles) or AU$440 (4WD vehicles), payable by cash,
Traveller’s Cheques or credit card. Should the Deposit be paid by cash,
a cash qualification process will apply. If paid by credit card,
authorisation will be gained.

The Security Deposit is fully refundable provided the Vehicle is
returned on time, to the correct location, undamaged, with a clean
interior and with full fuel tanks (fuel being petrol, diesel and LPG
gas).

Due to exchange rate fluctuations, there could be some variance between
the amount initially debited against the Customer’s credit card for a
Security Deposit and the amount refunded. Where any Security Deposit is
paid by credit card, Britz accepts no liability for such variation.

Britz reserves the right to retain a AU$125 soiling fee if the Vehicle
is not returned with the interior in a clean condition, and (when the
Vehicle is a 4WD car) free of mud. The toilet and waste water tank (if
applicable) must be emptied prior to the return of the Vehicle, or an
additional AU$125 soiling fee will be retained.

Except where the Customer has purchased Pre-purchase Gas Option and/or
Pre-purchase Fuel Option, failure to return the vehicle with full
petrol, diesel and/or LPG tanks will result in refill charges. Petrol,
diesel and LPG gas refill charges will be advised upon return of the
vehicle. In the instance of Excess Reduction Option 1 and Excess
Reduction Option 2, the credit card voucher will be returned to the
Customer (Campervans only).
RESPONSIBILITY IF ACCIDENT OCCURS

The excess is per accident and is applicable regardless of who is at
fault and must be paid at the time the accident report is completed, not
at the completion of the rental. The excess will be refunded if Britz
are successful in recovering the cost of the damages from the third
party. The Customer should understand that this could take months or
even years. If the Customer is involved in a motor vehicle accident
whilst on hire he/she shall follow this procedure.

At The Scene Of The Accident The Customer Must:
1. Obtain the names and addresses of Third Parties and any
Witnesses.
2. Report the accident to police, regardless of estimated damage
costs.
3. Not accept blame or insist other party is at fault.
4. Photograph damage to all vehicle(s) and registration number(s).
5. Phone the nearest Britz Branch with the accident’s details
within 24 hours.

At The Branch The Customer Must:
1. Produce their Driver’s Licence and hand over the police report
(if applicable) and any supporting photographs.
2. Pay the excess (if applicable) and any other amount due by
them in respect of any damage arising from an accident, loss or damage.
This amount is payable at the time of reporting ‘the event’ and not at
completion of the Rental Period.
3. The Customer Service Representative will ensure the Motor
Vehicle Accident Report is completed clearly and accurately signed by
the Customer.
EXCHANGE VEHICLE

1. The availability of an Exchange Vehicle is not guaranteed;
provision of such is subject to availability, client location and hire
length. Client charges may be incurred (see below).
2. If an Exchange vehicle is required as a result of an accident
(single or third party), the Customer is responsible for making their
own way to the nearest Britz branch or pick up location at their own
cost.
3. Britz may offer the Customer the option of paying an “Exchange
Vehicle Relocation Fee” to send a driver to deliver the exchange vehicle
to the Customer’s location.
4. The Customer will pay for any costs relating to delivery of a
change over vehicle as a result of an accident regardless of which party
is at fault.
TIME
FRAME FOR SETTLEMENT OF CUSTOMER EXCESS CLAIMS

1. The Claims Department strives to ensure that any money due
back to the client is forwarded as quickly as possible.
2. Third party claims can take months or even years to resolve.
Britz cannot force the destiny of these claims, it is up to Britz’s
Insurance Company and the third party, whether they be insured or not.
3. During periods of high utilisation, it is not always possible
to have the cost of our vehicle damage assessed immediately, however,
the Claims Department closely monitor these claims and make every
endeavour to have the damage repaired as soon as possible, enabling the
balance of excess to be refunded.
4. For information regarding outstanding claims or Excess refunds
please contact the Claims Department on +61 3 8379 8833 during office
hours.
5. The Customer will assist Britz in handling any claim arising
from any event, including providing all relevant information and
attending Court to give evidence.

Under no circumstances should the Customer attempt to start or drive a
vehicle that has been involved in an accident, damaged by roll-over,
water submersion or any other means without permission from a Britz
staff member. If the vehicle is undriveable after an accident and the
Customer would like to have a replacement vehicle, which will be subject
to time, distance and availability, the Customer must make his/her own
way (at the Customer’s expense) to the nearest Britz branch. In the
event that the vehicle is considered a write-off the Excess Reduction
cover will terminate. Should the Customer require a change-over vehicle,
a new Excess Reduction policy will be required.
RELEASE AND INDEMNITY OF BRITZ

(a) Subject to its obligation to deliver the Vehicle or an
appropriate substitute vehicle, the Customer releases Britz, its
employees and agents, from any liability to the Customer (regardless of
who is at fault) for any loss or damage incurred by the Customer by
reason of rental, possession or use of the Vehicle, including, but not
limited to:

(i) any loss or damage caused by breakdown, mechanical defect, accident
or the Vehicle being unsuitable for the Customer’s purpose;
(ii) any loss or damage to any property left in or on the Vehicle, in
any service vehicle or on any Britz premises or recovered or handled by
Britz. The Customer acknowledges that personal property is a personal
responsibility and is not covered by Britz or the Excess Reductions.

(b) Subject to the Excess Reduction Options agreed with Britz,
The Customer hereby indemnifies and shall keep indemnified Britz, its
employees and agents, against any claims, demands and expenses
(including legal costs) incurred or sustained by them or any of them by
reason of the Customers use and/or possession of the Vehicle.
INFRINGEMENTS

Britz reserve the right to charge the Customer for any speeding, parking
or tollway fines, associated administration costs and/or accidents
including third party property damage not reported on return of the
Vehicle. The administration fee per fine will be AU$60.
TAXES

A charge of 2.5% of the total cost may be levied to cover state
government taxes, duties and associated cost. This is payable upon
collection of the vehicle. Note: This charge is included in the
Inclusive component.
ERRORS IN RENTAL CHARGES

Total charges as set out herein are not final. The Customer will pay any
shortfall in charges to Britz and the Customer will receive a refund for
any overcharges acknowledged by Britz.
PAYMENT OF CHARGES - JOINT AND SEVERAL LIABILITY

All charges and expenses payable by the Customer under this Agreement
are due on demand by Britz. If the Customer does not pay all charges
when due, the Customer agrees to pay a late charge of 1.5% per month on
the outstanding balance and any collection costs incurred by Britz,
including reasonable legal fees. When the Customer comprises of more
than one person, each person is liable jointly and severally for all
obligations of the Customer pursuant to this Agreement.
CREDIT CARD PAYMENT

(a) Britz will accept payment by credit card, approved by Britz.
If a credit card is presented as payment, the credit card holder will be
jointly and severally liable as a Customer.

(b) Preferred credit cards are Visa Card and Mastercard. The
following credit cards will be accepted: Bankcard, Visa Card, Mastercard,
American Express. A surcharge of 2% applies for payment by American
Express (Campervans only)

(c) When payment is made by credit card, the Customer agrees
that:

(i) Britz is irrevocably authorised to complete any documentation and to
take any other action to recover from the Customer’s credit card issuer
all amounts due by the Customer pursuant to this Agreement, including,
but not limited to, any amounts due in respect of damage to the Vehicle
or to property of a third party and all other additional charges as they
are incurred (including all parking and traffic infringement penalties,
road toll fines and associated administration costs);

(ii) the Customer will not dispute his/her liability to Britz for any
amount due under this Agreement and the Customer shall indemnify and
keep indemnified Britz against any loss incurred (including legal costs)
by reason of notifying the Customer’s credit card issuer of such
dispute.

(iii) Britz may process the credit card voucher. In the event that Britz
elect to accept payment of the Security Deposit by holding a signed and
authorised open credit card voucher which is returned to the Customer at
the completion of the Rental Period, the Customer agrees that Britz are
entitled to recover payment from the Customer’s credit card issuer
pursuant to paragraph (i) in respect of any amounts due which were not
known at the time of return of the voucher.

(iv) Britz may process credit card charges pertaining to the rental
after the hire period.

(d) The Customer acknowledges that all transactions under this
Agreement are conducted in Australian dollars. Due to exchange rate
fluctuations, there could be some variance between the amount initially
debited against the Customer’s credit card and the amount refunded
within 7 days after the expiration of the Rental Period. Britz accept no
liability for any such variation.
PERSONAL AND COMPANY CHEQUES

Personal and Company cheques will not be accepted as payment for rentals
at the time of pick-up. These must be received by Britz 14 days prior to
commencement of rentals. Personal or Company cheques are not acceptable
as the vehicle security deposit.
CONDITIONAL UPON PAYMENT

The Customer agrees that where applicable, this Agreement is conditional
upon Britz being paid by the Travel Agent or Travel Wholesaler who
arranged this Agreement on the Customer’s behalf.
TERMINATING THE AGREEMENT AND REPOSSESSING THE VEHICLE

The Customer acknowledges that Britz may terminate this Agreement and
repossess the Vehicle (and for that purpose enter upon any premises and
remove the Vehicle) at any time, without notification to the Customer,
and that the Customer will pay the reasonable costs of repossessing the
Vehicle, including towing charges if:

(a) the Customer is in breach of any term of this Agreement;
(b) the Customer has obtained the Vehicle through fraud or
misrepresentation;
(c) the Vehicle appears to be abandoned;
(d) the Vehicle is not returned on the agreed return date or
Britz reasonably believe that the Vehicle will not be returned on the
agreed return date;
(e) Britz consider, on reasonable grounds, that the safety of the
passengers or the condition of the Vehicle is endangered.
The Customer understands that in the event of such termination or
repossession, the Customer has no right to a refund of any part of the
rental charges or the Security Deposit.
CHANGES

Any changes to this Agreement must be in writing and must be signed on
behalf of Britz and by the Customer.
PROPER
LAW

This Agreement shall be governed by the law of the State or Territory of
Australia in which the Agreement is signed.
CUSTOMER WARRANTIES

The Customer warrants that all information supplied by them to Britz in
connection with this Agreement is true.
ENTIRE AGREEMENT

This Agreement constitutes the entire agreement of the parties and there
are no other oral undertakings, warranties or agreements between the
parties relating to the subject matter of this Agreement. Britz reserve
the right to add or amend any rental charges without prior notice.
IMPORTANT

Britz reserve the right to refuse any rental at its discretion.

DEFINITIONS
‘This Agreement’ means the Rental Agreement and these Terms and
Conditions.
‘Britz’ means Tourism Holdings Australia Pty Limited. ABN 94 001 789 957
of Building 1, Central West Business Park, 9 Ashley Street, Braybrook
VIC 3019
‘Customer’ means the person or persons nominated as the hirer and any
person whose credit card is presented in payment of the Customer’s
charges.
‘Rental Agreement’ means the document headed ‘Rental Agreement’ and
signed by the Customer.
‘Rental Period’ means the hire period or any agreed variation thereof
and any additional period during which the Vehicle is in the Customer’s
possession or control.
‘Vehicle’ means the Vehicle hired by the Customer and includes tyres,
tools, accessories, camping utensils, the Kitchen Kit and any other
special equipment, documents or additional hire items related to the
Vehicle and any replacement or substitute Vehicle which may be provided
at the discretion of Britz.
‘Security Deposit’ means the Vehicle Security Deposit detailed under the
heading ‘Vehicle Security Deposit’ in the Rental Agreement and
calculated in accordance with this Agreement.
